Contractual Agreement Overview and Mission Statement


Note: EMC will be used in this statement as an abbreviation of "Eccentric Musician Company".


Mission:
To provide services for the original artist that also allows the artist to work and provide a service, talent or creative work back to the Label, our publication and other artists under the label. This agreement has a unique barter exchange of services component that separates us from the rest.  This agreement minimizes or completely eliminates artist accrued debt to the label that is typically paid back through a long term 360 royalty percentage to a Record Label.


EMC Royalty Fee's:
The EMC agreement will collect a percentage but the money collected is sorted differently than most contracts.  As the artist, throughout the contract term (or beyond) contributes services rendered back to the label, the EMC artist's account is updated and the balance due is depreciated based on the credit value amount given to the task performed.   A customized agreement is created and articulated in detail with each artist to insure each party can meet the desired goals within each contractual term period. 


EMC Global Percentage Royalty Return (GPRR):
Due to the fact that our own signed artist contribute to the success of the EMC label and that of their peers also signed to EMC. This GPRR is derived from the label percentage that each artist contributes to. This percentage funds the EMC Global Percentage Account. While the payout time of this percentage has not yet been decided upon, for now I will presume that it will be at the end of the artist's contractual term or at the end of each tax year. The payout will be dependent upon the artist's on time delivery of tasks performed (not artist performance statistics).


Services rendered by EMC and Affiliates that effects the original artist's contract:

This is an equally important communication regarding what services are needed and is best suited for the artist at the time of signing a contractual agreement with EMC.  My mission is to always place the artist first. Not every artist will need a professional recording, some may come and already have that in place. The artist may only need promotional support in a specific area or perhaps all areas. Some artists may need a professional recording and the rest that follows while some may only need distribution and playlist promotional support. The delivery of services rendered will effect your contract's debt. amount balance due.  Therefore, it easier for me to provide services that I already offer in-house and be able to manage the artist's payback through the barter exchange component of the contract rather than farming services out to an outside affiliate. So that needs to be understood.  Any service's rendered outside of my in-house offerings will most likely be a paid service. Some available services and contacts are more pliable than others and creative arrangements can be worked out for example  "singer/songwriter X is going to have her tracks mixed at our affiliate's studio. The studio also needs a female backing vocal on a project they are working one" we work out a deal and henceforth your balance due is now adjusted accordingly.

 
Faith in contractual follow through:
I for one am not a big fan of lawyer expense, but legal advise and administration is a necessity in the music business.  That being said it is important to me to sign the right people in the first place. At EMC I expect everyone to work as a team in helping each other's career and that of the label. Without that the Label's business structure would fall apart and artist's will not re-sign to another contract term or be able to move forward to another more prominent label opportunity without having a strong history.  Signing people who possess religious faith is a determining factor and that is my right to do so, signing people who have shown a contribution back to society or a local organization is a determining factor. If you were an Eagle scout or have reached a high level in girl scouts is determining factor. Whether or not you opted to show skin and beauty rather than raw talent on a social network is a determining factor.
